I'm running a D20 Modern game in which my players have access to D&D spells. This situation though could easily come up in a standard D&D game. One of my players is playing a Duskblade and has access to the Swift Ready spell. He recently used the spell to steal the Hope Diamond by casting Swift Ready on the Hope Diamond and then walking out of the building and calling it to him. I let it happen because it would be more fun that way, but it got me wondering RAW is this allowed? The Swift Ready spell states that the object in question "cannot be in the possession of any other creature". Clearly if a creature is holding the object they are in possession of it, but with something under a glass casing this is a little less clear. RAW can the Swift Ready spell be used to steal items from a display? Why or why not?

\$\begingroup\$ We did not house rule the time requirements, but I wasn't aware of a touch requirement. The spell text says "You must have line of sight to the equipment" so I assumed there was none. EDIT: Its not too hard to stare at the Hope Diamond for a minute. \$\endgroup\$
